Key amendments under Legal Metrology (Packaged Commodities) Amendment Rules, 2022, effective from 01 October 2022

In furtherance to the below update circulated wherein key amendments in respect of the Legal Metrology (Packaged Commodities) Rules, 2011 (‘LMPC Rules’) were highlighted which were proposed to be made effective from 01 April 2022, have now been made effective from 01 October 2022 vide Notification dated 28 March 2022, issued by the Ministry of Consumer Affairs and Food and Public Distribution

Key aspects of the said Notification in respect of the amendments in the LMPC Rules are summarized hereinbelow:

  • No prosecution shall be initiated against any manufacturers, packagers or importers of pre-packaged commodities who have implemented the new MRP sticker regulations effective from 01 April 2022
  • Rule 6(11) of the LMPC Rules has been substituted by the Notification, with the following amendments :
    1. Unit sale price in rupees, rounded off to the nearest decimal place, shall be declared on every pre-packaged commodity in the manner prescribed hereunder :
      • Per gram where quantity is less than one kilogram and per kilogram where net quantity is more than one kilogram
      • Per centimetre where length is less than one metre and per metre where net length is more than one metre
      • Per millilitre where net volume is less than one litre and per litre where net volume is more than one litre
      • Per number or unit if any item is sold by item or unit

2. For packages containing alcoholic beverages or spirituous liquor, State Excise Laws and Rules                           thereunder shall be applicable within the State in which the package is manufactured

3.In case pre-packaged commodities having equal retail sale price and unit sale price, the                                     declaration of unit sale price is not required

  • The Second Schedule to the LMPC Rules which specified the quantity, weight, measure or number to be packaged for certain commodities has been omitted by the Rules

The above amendments in the LMPC Rules shall come into effect from 01 October 2022.
