Union Budget 2023-24: Top-10 Indirect Tax Proposals
Key Proposals under the Goods and Services Tax (GST) Law

  • Liability to obtain registration and deposit the applicable GST on the overseas providers of Online Information and Database Access or Retrieval (OIDAR) services widened:
    • ambit extended to all the supplies made to unregistered customers located in India, whether or not such supplies are received for business purpose
    • services to qualify as OIDAR even if they are not essentially automated and involve human intervention
  • ITC restricted in respect of goods and services used or intended to be used for activities related to discharge of Corporate Social Responsibility (CSR) obligations under the Companies Act, 2013
  • Restriction on opting of composition scheme imposed on the taxpayers supplying goods on electronic portal to be removed
  • Place of supply of transportation services to be in India where the service provider and recipient both are in India, irrespective of the destination of such goods
  • Manner of computing interest payable on delay in grant of GST refunds to be prescribed
  • Taxpayers restricted from filing of the Forms GSTR-1, GSTR-3B, GSTR-9 and GSTR-8 after the expiry of 3 years from the applicable due date
  • Introduction of penal provisions on e-commerce operators in the case of contravention related to supply of goods by unregistered and composition taxpayers through their e-commerce portal

Key Proposals under the Custom Law

  • Time limit of 9 months introduced for disposal of matters by the Settlement Commission
  • Reduction in Basic Customs Duty (BCD) rates on various products, for example:
    • Camera lens and its inputs/parts for use in manufacture of camera module of cellular mobile phone from 2.5% to Nil
    • Specified parts for manufacture of open cell of TV panel from 5% to 2.5%
  • Exemption from levy of Social Welfare Surcharge on various products like silver, bicycles, specific toy and toy parts
